Terms of Service

These Terms of Service ("Terms") govern your use of the Eyezo mobile application ("the app") developed by Shanu Tyagi ("we," "our," or "us"). By downloading, installing, or using Eyezo, you agree to be bound by these Terms.

1. Description of Service

Eyezo is a health and wellness application that helps protect your eyesight by implementing the 20-20-20 rule: every 20 minutes of screen time, the app reminds you to look at something 20 feet away for 20 seconds. The app provides break reminders, screen time tracking, eye care analytics, and related features.

The app also includes an Exercise & Wellness feature offering 9 guided eye exercises and educational nutrition information. These exercises and nutrition details are provided for general wellness purposes only and are not a substitute for professional medical treatment, physiotherapy, or nutritional advice. Users with pre-existing eye conditions, neck or back issues, or any other medical concern should consult a qualified healthcare professional before using the exercise features.

The app supports 17 languages to serve users around the world.

Eyezo is a wellness tool and does not provide medical advice, diagnosis, or treatment. Always consult a qualified eye care professional for medical concerns.

2. Account Registration

  • You may use Eyezo as a guest with limited features, or create an account for the full experience.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate information when creating an account.
  • You must be at least 16 years old to create an account.
  • One account per person. Account sharing is not permitted.

3. Free and Premium Plans

Eyezo offers a free version with advertisements and a premium subscription with additional features.

  • Free Plan: Core eye care features with ads. Some features may be limited.
  • Premium Plans: Ad-free experience, premium Sanctuary theme, unlimited app customization, and additional features as described in the app.

4. Subscriptions & Payments

  • Premium subscriptions are billed through Google Play Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in Google Play Store → Subscriptions.
  • Refunds are handled according to Google Play Store's refund policy.
  • We reserve the right to change subscription pricing with reasonable notice.
  • Promotional pricing, coupons, or trial periods may be offered at our discretion.

5. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the app
  • Modify, adapt, or create derivative works from the app
  • Use the app for any unlawful purpose
  • Attempt to gain unauthorized access to our servers or systems
  • Interfere with other users' use of the app
  • Submit false, misleading, or harmful content through feedback
  • Use automated tools, bots, or scripts to interact with the app

6. Permissions

Eyezo requests certain device permissions to function properly:

  • Usage Access: To track screen time and determine when you need an eye break. This data stays on your device.
  • Display Over Other Apps: To show the eye care overlay reminder on top of your current app.
  • Notifications: To send break reminders. You can disable these at any time.

During breaks, the app uses your device's on-device text-to-speech (TTS) engine to provide optional audio guidance. No audio data is sent to any external server. The app may also temporarily pause media playback when a break overlay is triggered to encourage you to step away from the screen.

You can revoke any permission at any time through your device settings. Some features may not work without the required permissions.

7. Intellectual Property

  • The Sanctuary and Ocean themes, including all visual elements, are proprietary.
  • You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
  • Eyezo's design, code, branding, themes, and the specific compilation and presentation of content within the app are owned by Shanu Tyagi. Underlying scientific concepts, exercises, nutrition facts, and statistical data cited in the app are public-domain and not subject to this ownership claim.

8. Health Disclaimer

Eyezo is not a medical device or medical service.

  • The 20-20-20 rule is a general wellness guideline, not a medical prescription.
  • Eye care analytics, blink test results, and compliance scores are for informational purposes only.
  • The app does not diagnose, treat, cure, or prevent any eye condition or disease.
  • If you experience eye pain, vision changes, or other symptoms, consult an eye care professional immediately.
  • We make no guarantees about the effectiveness of the 20-20-20 rule for any individual.
  • Exercise content: The eye exercises provided are general wellness exercises. They are not physical therapy or medical treatment. If you have an eye condition, recent eye surgery, or experience discomfort during any exercise, stop immediately and consult a qualified eye care professional or physiotherapist.
  • Nutrition content: Nutritional information in the app is educational content based on EFSA-approved dietary guidelines and is provided for general awareness only. It is not personalised nutritional advice, medical dietary guidance, or a treatment plan. Consult a qualified dietitian or healthcare professional before making significant changes to your diet.
  • Users with pre-existing medical conditions — including but not limited to eye disorders, neck or back problems, or cardiovascular conditions — should seek professional medical advice before using the exercise or wellness features of this app.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Eyezo is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted or error-free operation of the app.
  • We are not liable for any damages arising from your use of the app, including but not limited to eye strain, vision problems, or data loss.
  • Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim.

10. Service Availability

  • We strive to keep Eyezo available at all times but do not guarantee 100% uptime.
  • We may temporarily suspend the service for maintenance, updates, or security reasons.
  • Features may be added, modified, or removed at our discretion.
  • We reserve the right to discontinue the app with reasonable notice to users.

11. Account Termination

  • You may delete your account at any time through Settings → Account → Delete Account.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon deletion, your personal data will be removed from our servers. Local data is deleted when you uninstall the app.
  • Active subscriptions should be cancelled through Google Play Store before deleting your account.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or via email. Continued use of Eyezo after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India, subject to the arbitration clause below.

14. Arbitration & Dispute Resolution

Before filing any legal action, you agree to first contact us at eyezo.app@gmail.com and give us 30 days to resolve your concern informally. If the dispute cannot be resolved informally, both parties agree to resolve it through binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with a single arbitrator in Delhi, India. Each party shall bear its own arbitration costs unless the arbitrator rules otherwise. This clause does not prevent you from pursuing small-claims remedies available under applicable law.

15. Class Action Waiver

To the maximum extent permitted by law, you agree that any dispute will be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action.

16. Indemnification

You agree to indemnify, defend, and hold harmless Eyezo, Shanu Tyagi, and any affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your misuse of the app, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) content you submit to us (such as feedback).

17. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

18. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, acts of war, civil unrest, pandemics, government restrictions, internet or cloud-service outages, denial-of-service attacks, or failures of third-party providers.

19. Feedback Ownership

Any feedback, suggestions, feature requests, or ideas you voluntarily submit to us (through the in-app feedback form, email, or any other channel) become our property. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into Eyezo or any related product without any obligation to compensate, credit, or notify you.

20. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer these Terms (in whole or in part) without restriction — including in connection with a sale, merger, acquisition, or reorganization of our business.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding Eyezo and supersede any prior agreements, representations, or understandings — whether written or oral. No verbal statement, email, or informal communication overrides these written Terms.

22. Apple App Store Additional Terms

If you obtained Eyezo from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Shanu Tyagi only, not with Apple. Apple is not responsible for Eyezo or any claims relating to it.
  • Apple has no obligation to provide any maintenance or support services for Eyezo.
  • If Eyezo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or any third party relating to Eyezo, including product liability, legal or regulatory compliance, or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
